A surveyor issues the survey certificate concerning a property. The survey certificate contains two sections:
1- A descriptive section that indicates:
the lot numbers its subdivision and cadaster;
the easement that may affect the property;
any irregularities as illegal views, encroachment etc;
the conformity to by-laws.
2- A plan illustrating:
the location of the building on the land;
where the servitude are exercised;
illegal views;
encroachment
dimensions of the building
the dimensions of the land;
the limits of the land.
A survey certificate is required on real estate transactions in order to clearly indicate what is the object of the transaction. Survey certificates are required by financial institutions that will grant a mortgage on the property.
A survey certificate is generally valid for a period of 10 years.
The vendor of a property normally supplies the survey certificate. Check carefully your purchase offer in that regard. Most of the purchase offers stipulate that the vendor must supply a valid survey certificate that indicates the actual status of the property. If then you require a new survey certificate and that it shows no modification to the one that your vendor has supplied, you may have to pay the costs of that new survey certificate.
